New World Distribution and its staff appreciate your business and will make every effort to provide a pleasant shopping experience. Please be advised that due to the items being “limited edition” products and pre-sold, purchasing is on a first come, first served basis and once they are sold out there will be no more manufactured.  The purchase of product during pre-sell reserves your product in the production run.  Your product will ship upon the scheduled week of product completion based on when your individual order was received.   

 The terms and conditions below explain how we sell our products, process our orders and how we handle returns, exchanges, and refunds. Please review them carefully to ensure that you agree with our sales terms and conditions.

All use of this site, including the placing of any order with New World Distribution, indicates your acceptance of the terms and conditions listed below. Please read the following policies, terms and conditions before submitting an order to New World Distribution. These terms and conditions shall supersede all policies published on past web documents, sales receipts, and emails. New World Distribution reserves the right to make changes to this site and these terms and conditions at any time without notice.

SALES, SUPPLY AND PAYMENT OF PRODUCTS FROM New World Distribution “SUPPLIER” TO YOU “CUSTOMER”

Applicability

1. These conditions are applicable to all sales from New World Distribution hereafter referred top as the Supplier, unless in the event of deviation from any condition hereof in a separate written agreement.  Once payment has been received, the Supplier will confirm that the order has been accepted by sending an email of confirmation to the email address provided by the Customer and the Supplier.
2. Supplier is not responsible for the consequences of faulty or inaccurate receipt of information, orders and/or agreements by reason of the failure of the means of communication used.
3. Products sold on this website are “pre-sell” status meaning that you agree to pay in advance for a copy of the artist’s works which appear here for sale at the time of purchase.  Your credit card will be charged for the full amount of sale including any taxes and shipping charges on the date of purchase.  The product will be shipped on or before the stated shipping date contained within the product description. 

Prices

1. All quoted prices are, unless expressly mentioned otherwise, based on US dollars and shipped from warehouses in the USA where the goods of the Supplier are stored.
2. The Customer will be required to pay extra for delivery as quoted in the postage section of our website.

Force Majeure
The Supplier has no liability to the Customer for any failure to deliver any ordered goods, or any delay in delivery, or for any damage or defect to the good delivered that is caused by circumstances that are beyond reasonable control.

Authorized Rights

1. For all agreements with the Supplier, or agreements originating from those, as well as these terms and conditions of sale, supply, and payment, California law is applicable and the California courts shall have jurisdiction over any dispute arising between the Customer and the Supplier.
2. Nothing said by any person on behalf of the Supplier should be understood as a variation of these terms and conditions, or as an authorized representation regarding the quality and nature of items offered for sale by the Supplier.  The Supplier shall have no liability for any such representation being untrue or misleading.

System Misuse
Any attempts to enter into any secured area of 180gramrecords.com without authorization is strictly prohibited.  New World Distribution reserves the right to report such illegal activities to any and all regulatory, administrative and/or governmental authorities for appropriate prosecution.

Change of Terms
The Internet is an evolving medium.  New World Distribution reserves the right to change their terms and conditions if required.  Any changes made to the terms and conditions will be displayed on this page of the website.
Nothing in the above terms and conditions affect any of your statutory rights as defined by California law.

Privacy Policy
New World Distribution and its staff value your privacy.  Your personal information is for use by New World Distribution in order to serve you.  This information is kept on a secure server to protect it from outside parties, and is information used for the limited purpose of processing your order.  Information may also be used for statistical purposes, to improve our website and services to you, to administer our site, and to notify you of products or special offers that may be of interest to you.  Your personal information will not be sold or shared with third parties.

Order Acceptance Policy
Your email receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.  As a result, item availability, shipping schedule and prices are subject to change at any time without notice.  New World Distribution reserves the right to limit quantities, and to decline the acceptance of any order for any reason.  New World Distribution reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity ordered of any item and refund the purchase price for the undelivered items.
All orders placed will be thoroughly researched before shipping, in accordance with the policies set by New World Distribution.  New World Distribution may require additional information and/or verification before accepting and processing any order.

Credit Cards
New World Distribution accepts all major credit cards, and there is no surcharge for using your credit card to make a purchase.  All transactions are in US dollars are and processed by a US bank.  International orders will be charged in US dollars and the actual charge depends on the daily US dollar conversion rate for your currency.  Please be sure to provide the exact billing address and telephone number as recorded with your credit card issuing bank.  We will ship to an alternate address only if the billing address is on file with your credit card issuing bank.  Incorrect information may cause a delay in the processing of your order.
All orders are charged to the credit card you indicate at the time of your purchase.  In order to track availability of purchased products, place orders, and expedite the processing of your order in general, your order must be fully paid at the time you place it.

Order Cancellation
Any order submitted through this website can only be cancelled within 7 calendar days of ordering.

Return Policy
Any product may be returned for a refund within 14 calendar days of receipt of products only if unopened and unused.  All return postage and insurance is the responsibility of the purchaser.  All returns are subject to approval after contacting the New World Distribution Customer Service Department by emailing us at info@180gramrecords.com  RETURNS WILL NOT BE ACCEPTED WITOUT PRIOR APPROVAL BY OUR CUSTOMER SERVICE DEPARTMENT.  Our customer service will send you instructions on where and how to return your purchase for a refund of its purchase price.  Please note that returns that do not include a return authorization number on the address label, will be refused.  Returns should be sent to:

Shipping costs are not refundable except for defective items or items sent in error.  Defective items will be exchanged for the same items.  Defective returns that are found to be non-defective are subject to a 15% restocking fee.
DO NOT DISCARD ANY PACKAGING OR INVOICES UNTIL YOU ARE COMPLETELY SATISFIED WITH THE PRODUCT SHIPPED.  ITEMS RETURNED WITHOUT THE ORIGINAL MANUFACTURER’S PACKAGING, OR DAMAGED PACKAGING MAY BE REFUSED OR RETURNED AND WILL BE SUBJECT TO THE RETURN POSTAGE COST.

All our products are sold with a 30-day guarantee against defects.  Defective merchandise will be replaced at our discretion.  We will gladly answer presale questions on any product.  All non-defective, unopened returns are subject to a 15% restocking fee.

All returns are subject to the following:
Shipping, insurance, and handling charges are not refundable.  It is recommended that returns be shipped insured as New World Distribution assumes no liability for lost or damaged return shipments.  Save your tracking numbers as they can prove invaluable if your return is lost in transit to us.  Your purchase must be returned with shipping pre-paid.  All products must be in “as-new” condition, in original packaging.

Shipping Policy
Shipping charges are calculated based on the total weight of all items in your order.  The shipping cost charged at the time of purchase represents an estimate using standard Air Mail or US Priority Mail.  Requests for Express Mail Service or special handling will be billed separately based on published rates plus a small handling fee.
Shipping charges are non-refundable.
We require a signature for all delivered goods based upon the high value of the time and that they are limited edition units.  Please be advised that your item(s) will require a physical signature for release from the shipper.
An additional charge of $5.00 will be charged to your credit card for any refused or returned as undeliverable shipment.
Note: Please keep in mind that our distribution centers do not process or ship orders on weekends and/or holidays.

Sales Tax
New World Distribution charges sales tax on all US shipments.  You will be charged the appropriate tax rate based on delivery address zip code.

Copyright
Worldwide copyright laws and treaty provisions protect all materials appearing anywhere on the New World Distribution website.  None of these materials may be copied, reproduced, modified, or distributed in any form or by any other means without the written consent of New World Distribution.  Any unauthorized use of the materials appearing on New World Distribution’ website may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

Trademark and Service Marks
All trademarks or service marks are property of New World Distribution and its respective partner owners.

Disclaimer
New World Distribution makes no representations or warranties, either expressed or implied, of any sort with respect to the New World Distribution web sites, materials, their operation, information or content.  You, the purchaser, agree that New World Distribution, its directors, officers, employees and/or representatives, shall not be liable for damages arising from the operation, content or use of New World Distribution sites or the products sold therein.  You agree that this limitation of liability is comprehensive and applies to all damages of any sort, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages.

Jurisdiction
Any litigation regarding this agreement, or any transaction between a customer and New World Distribution, shall be brought to the state or federal courts located in Los Angeles County, California and the customer hereby agrees and submits to such jurisdiction and venue as proper.

Compatibility
As New World Distribution is not the manufacturer of any products we sell, we make no representations, guarantees or warranties of any kind, either expressed or implied, and assume no liability for any financial loss or damage caused by a product purchased from us.  The sole and exclusive maximum liability to New World Distribution arising from any products sold on this site shall be the price of the product ordered, if found liable.  In no event shall New World Distribution, its directors, officers, employees and/or representatives be liable for special, indirect, consequential, or punitive damages relative to the compatibility of products sold.
Typographical Errors
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, New World Distribution shall have the right to refuse or cancel any orders placed for products listed at the incorrect price without prior notification.  New World Distribution shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.  If your credit card has already been charged for the purchase and the order is canceled, New World Distribution shall immediately issue the credit for the amount of the incorrect price.
